Florida's attorney general asks a court to stop OpenAI developing new AI models without outside safety approval

James Uthmeier's motion in Highlands County also asks the court to keep ChatGPT away from Florida minors and to bar it from presenting itself as human.

On Monday 28 September, Florida Attorney General James Uthmeier asked a state court for a temporary injunction against OpenAI and its chief executive Sam Altman, News4JAX and FOX 13 reported. The motion was filed in the Circuit Court of the 10th Judicial Circuit in Highlands County, inside the lawsuit his office brought on 1 June, which alleges deceptive trade practices, negligence, defective design, failure to warn and public nuisance. The attorney general's own release refused us twice, so this story rests on the outlets named.

The motion's first request is to bar OpenAI from “Developing any artificial intelligence models without independent third-party guardrails and approval,” as the Florida Phoenix, republished by WLRN, quotes it. It also asks the court to stop OpenAI offering ChatGPT to minors in Florida and to limit data collection from children under 13. Further requests would stop OpenAI calling ChatGPT safe or accurate without warnings, presenting the chatbot as human, and using features that prolong conversations. The motion cites the Hugging Face breach.

OpenAI's director of strategic communication, Drew Pusateri, said: “People want to know AI is being developed safely, and that starts with what companies like ours do ourselves”. He said the company had paused training its most capable models until more safeguards are in place. No ruling or hearing date was reported.
